ONLINE PERSONAL PROPERTY - TERMS & CONDITIONS

PLEASE READ AND REVIEW THE TERMS THOROUGHLY PRIOR TO BIDDING. IF YOU HAVE NOT READ AND UNDERSTAND THESE TERMS, PLEASE DO NOT BID. BY BIDDING ON THIS AUCTION, BUYER AGREES TO ALL TERMS AND CONDITIONS SET FORTH AND ENTERS INTO A CONTRACTUAL AGREEMENT TO PURCHASE THE ITEMS(S) UNDER THE FOLLOWING TERMS AND CONDITIONS:

General Terms of the Auction: Information is subject to change. All lots are sold as is, where is, with all faults, imperfections and errors of description. Due diligence is the responsibility of the bidder/buyer as we provide as many pictures as possible and describe any imperfections we see. Items are available to be inspected by appointment and recommended if you have concerns. All sales are final. No credit card charge backs will be allowed. All statements made prior to the sale of any item take precedence over written material and any prior verbal statements. Lost River Auction Service is not responsible for accidents, thefts, errors or omissions.

1. Printed statements or descriptions by staff are provided in good faith and are matters of opinion.

2. Buyer�s Premium & Sales Tax: There is a 15% buyer�s premium added to your total purchase. Please factor this into your bidding online. NO SALES TAX will be collected on anything that does not have a title since it's onsite. Indiana sales tax laws apply to the titled items only (utility vehicle - Lot 5 & trailers - Lots 8 & 9).

3. Registration: In order to better serve our customers, all bidders must provide their name, address, daytime phone number, and email address at which they can be contacted. This is to insure good communication between Lost River Auction Service and the bidder throughout any transactions. We also require you to register with a credit/debit card. The card information is kept confidential and no charges for items won will be made to these cards. Lost River Auction Service reserves the right to preclude any person from bidding if there is any question as to the person�s credentials, mental fitness, etc. Bidders agree to keep their username and password confidential as they are responsible for ANY and ALL activity involving their account. If the registered bidder�s user name is offensive to Lost River Auction Service or in their sole opinion detrimental to Bidding Activity, then Lost River Auction Service reserves the right to delete the bidder from bidding or unilaterally change the username with notification to the Bidder. When using the web site you must obey any and all local state and federal laws. Violations will result in termination of web site use privileges.

4. Payments: For this auction you may pay before or at pickup: Cash, Credit Card or Paypal. NO CHECKS ACCEPTED. If you are a successful bidder, you will receive an email invoice to be paid. 4.5% added to for all credit cards, debit cards or Paypal payments.

The TRACTOR (Lot 1) will require CASH or a WIRE TRANSFER ($10 fee) before being removed from the property.

ALL GOLD LOTS must be paid in CASH ONLY (Lots 220-222).

5. Pickup Day: Thursday, July 17 from 12 -7 PM EST at 1904 N. Woodland Lakes Dr., English, IN 47118.

6. Shipping: SHIPPING AVAILABLE ON SELECTED ITEMS, AS NOTED.

7. Preview of items on Monday, July 14 from 4-6 pm EST.

8. Unpaid Balances: The purchaser agrees to pay all reasonable attorney fees and costs incurred by Lost River Auction Service in the collection of funds. The purchaser also agrees that a fee of 2% per month be added to the balance of any unpaid balance due Lost River Auction Service and any other costs or losses incurred by the purchaser�s failure to adhere to these terms. Any debt collection or dispute proceedings will be heard in Orange County, Indiana.

9. Technical Issues: In the event there are technical difficulties related to the server, software, internet or any other online auction-related technologies, Lost River Auction Service reserves the right to extend bidding, continue the bidding or close the bidding. In the event of these issues happening during the actual closing of the auction, all previous bids on lots affected in the auction can be cancelled. Neither the company providing the software, nor Lost River Auction Service, shall be held responsible for the failure of the software to function properly for any reason.

Due to the recent passing of her husband, Stan, Vicky Deig will be downsizing and offering a wide variety of items. Stan was an electrician for many years and was well-known for taking care of his items. There are NO RESERVES. This is an ABSOLUTE AUCTION. There is an elevated minimum required bid for Lot 1 only. Lot 1 - Tractor - Must be paid in CASH or WIRE TRANSFER before removal. Lots 220 - 222 - Gold Rings - Must be paid in CASH Only. All other items can be paid in cash, credit/debit card or Paypal. There is a 4.5% additional fee for credit/debit card or Paypal. at pickup. SHIPPING AVAILABLE ON SELECTED ITEMS, AS NOTED, WITH PAYMENT BY CREDIT CARD. PLEASE BRING THE PROPER EQUIPMENT AND MANUAL LABOR TO LOAD YOUR ITEMS, AS THERE WILL BE NONE AVAILABLE ON SITE.
