All persons desiring to bid online and live must be registered prior to the auction and must have obtained a Bidder's number. Must be 18 years of age to register with valid picture ID. You must register with a credit card. The credit card authorization is a "good faith" deposit assuring that you will pay for all of the vehicles that you purchased in the bid process. If you bid and do not pay you will be banned from our auctions permanently no exceptions.
JD Newell Auctioneers, Inc., herein after referred to as the Auctioneer, reserves the right to add to or withdraw from the auction any items listed or not listed, to group individual lots into larger lots for sale, to subdivide lots into smaller lots forsake, or to sell all lots in bulk when it is in the best interest of the Seller. JD Newell Auctioneers, Inc, has the right to extend or postpone a auction when needed. (ex. bad weather or holiday)

All items are sold AS IS, WHERE IS with no warranty, expressed or implied. The Auctioneer shall not be responsible for the correct description, authenticity, genuineness, or defect in any lot and makes no warranty in connection therewith. No allowance, or refund will be made on account of any incorrectness, error in cataloging, imperfection, defect or damage. Any descriptions or representations are for identification purposes only and are not to be construed as a warranty of any type. It is the responsibility of the Buyer to have inspected thoroughly the merchandise and to have satisfied himself or herself as to its condition and value and to bid based upon that judgment.
The Auctioneer is acting as Agent for the Seller and all representations made by Auctioneer are made on behalf of the Seller. The Auctioneer is not responsible for the acts or representations of the Seller. Any action or recourse will be directed to the Seller and not to the Auctioneer.

Settlement must be made in full immediately upon the completion of the auction. Auctioneer reserves the right to charge card on file for payment of invoice. ANY INVOICES OVER $5,OOO CANNOT BE CHARGED TO CARD YOU MUST WIRE THE MONEY OR PAY IN PERSON CASH, OR CASHIERS CHECK . CALL FOR WIRING INSTRUCTIONS.

IF YOU DO NOT WANT CARD ON FILE CHARGED YOU MUST MAKE ARRANGEMENTS BEFORE SALE. IF YOU WANT TO PAY IN PERSON WITH CASH, MONEY ORDER OR CASHIERS CHECK YOU CAN DO SO IN PERSON AT OUR ROYSE CITY OFFICE ONLY. IF YOU ARE FROM OUT OF STATE YOU MUST WIRE TRANSFER MONEY-NO CREDIT CARD TRANSACTIONS WILL BE ACCEPTED. OR YOU MAY SEND CASHIERS CHECK OVERNIGHT.

Merchandise not paid for and removed within the specified time period may be resold without notice. If items purchased are not removed within 7 days of auction close, the buyer FORFEITS ALL MONIES PAID and the property REVERTS to Seller with NO RECOURSE.PAYMENT: If for any reason your card on file is declined, it is your responsibility to make full payment within 48 hours of auction close.

Buyer agrees to NO credit card chargebacks. IF YOU initiate a credit card chargeback, even if successful, YOU will remain liable for all purchases made at the Auction, and YOU will be responsible for all costs and expenses, including attorneys' fees, incurred by or on behalf of Auctioneer and/or any Seller(s) in challenging the credit card chargeback and in collecting payment. YOUR agreement not to initiate a credit card chargeback is a condition to YOUR Registration as a Bidder, and for the privilege of bidding at the Auction, and is being made as an inducement for Auctioneer to accept YOUR Registration and to permit YOU to bid at the Auction. Auctioneer is relying on YOUR agreement not to initiate a credit card chargeback in accepting YOUR Bidder Registration and in permitting YOU to bid at the Auction.

The Buyer agrees that a bid constitutes acceptance of each and every term and condition, and of any additional terms and conditions which may be posted at the auction or which may be announced by the Auctioneer.

The Buyer agrees that in any dispute between the Seller and the Buyer or between competing bidders with any sale at the auction, the auctioneer shall have the right but not the obligation to settle dispute, and the Buyer shall abide by the decision of the Auctioneer, whose decision shall be final with respect to matter.

The Buyer agrees to pay the Auctioneer for all liabilities, damages, costs, and expenses including attorneys fees incurred in connection with any dispute or in connection with any claim, litigation, controversy, dispute or proceeding from any purchase by the Buyer or from any subsequent sale to any third party.

Disposing of unwanted items or trash from auctioned vehicles onto property WILL NOT BE TOLERATED. Anyone caught doing so will be permanently banned from all Live and Online auctions conducted by JD Newell.
