� The terms of sale are non-negotiable. Registering to bid either live, online or absentee signifies your acceptance of the terms. Your bid is a binding agreement. Do not place a bid unless you intend to honor it. Bid Retraction will result in immediate suspension of all bidding privileges.

All inspections must be completed prior to bidding. � SOFT CLOSE AUCTION: If a bid is received within the final 2 minutes, then time will be extended an additional 2 minutes. � PROPERTY: 2230 Overlook Crest, Vestavia AL 35226 � LEGAL DESCRIPTION: Lot 2, according to the Survey of Overlook Crest, as recorded in Map Book 210, Page 43, in the Probate Office of Jefferson County, Alabama.. � REGISTRATION: To register, bidder must submit a signed copy of these Terms along with a $5,000 Registration Deposit to Heritage prior to the auction: either in the form of CASH, or CERTIFIED CHECK made payable to Heritage Realty & Auction or by WIRE to Heritage�s Escrow account (wire information available upon request). Said Registration Deposit is returnable if you are not the winning bidder. � TERMS: 10% of Bid Price due within 48 hours of the auction's end, balance due at closing within 45 days of Seller/Court approval. Subject to Seller/Court approval. Not subject to financing. Subject to any easements, restrictions, applicable limitations, rights of way and planning and zoning regulations. At closing, Seller to pay for deed preparation, prorated taxes, and all auctioneer's fees. Sorry no credit/debit cards for payment of deposit. � SALES CONTRACT: The contract is required to be fully and correctly completed, without any modifications, properly signed and submitted to Heritage within 48 hours of the auction's end. Seller reserves the right to solicit backup contracts. � HOA DUES: currently $270/mo, already paid for 2025 � BUYER'S PREMIUM: None for this auction. � CONDITION: The real estate described herein is being sold on an �AS-IS, WHERE-IS, WITH ALL FAULTS� basis. The term �AS-IS, WHERE-IS, WITH ALL FAULTS� means that the property is purchased as it exists without any representations or warranties whatsoever regarding its physical condition or quality. Buyer further certifies that they have examined the property described hereinabove; that they are thoroughly acquainted with its conditions and accept it as such. � BIDDER/BUYER DEFAULT: High Bidder/Buyer not executing and returning the Sales Contract with 10% of Bid Price within 48 hours of the auction's end will be considered in default. In the event a high Bidder/Buyer fails to submit the signed Sales Contract and 10% of Bid Price, the high Bidder/Buyer shall pay to Heritage, as damages, an amount equal to the Registration Deposit, as set forth in Terms, and any and all expenses incurred by Heritage, for said auction. Should high Bidder/Buyer's deposit check be returned for any reason whatsoever, this shall constitute an item of default, and in addition to the remedies previously stated herein above, high Bidder/Buyer shall also pay an additional penalty of five percent (5%) of the check amount to Heritage. High Bidder/Buyer shall also pay a reasonable attorney's fee and costs incurred in the collection of these monies owed by high Bidder/Buyer as a result of high Bidder/Buyer's default. High Bidder/Buyer shall also pay the Seller any damages caused by said breach of contract, including attorney's fees and costs. This shall not preclude the Seller from suing for specific performance of the Sales Contract, in addition to said damages. Any disputes will be tried in a court of jurisdiction in Jefferson County, Alabama. Heritage reserves the right to sell to the next highest qualified Bidder/Buyer in the event the successful high Bidder/Buyer does not comply with the terms of the sale. The Sales Contract is required to be fully and correctly completed, without any modifications and properly signed.
