**BY PLACING A BID, BIDDER CERTIFIES THAT THEY HAVE READ AND WILL ABIDE BY ALL TERMS AND CONDITIONS AS STATED BELOW. **IT IS THE BUYER'S RESPONSIBILITY TO UNDERSTAND ALL THE TERMS AND CONDITIONS PRIOR TO BIDDING. **ON-LINE BIDDING This is a timed, Online-only Auction; the highest bid online when the bidding closes will be the winning bid for the item. This auction will incorporate a "SOFT CLOSE". Bidding within the last minute before the closing of an item will extend the bidding time by an additional minute. This prevents individuals from placing a bid on an item at the last second to prevent others from bidding more. **BUYERS PREMIUM: Buyer's premiums do apply on all on-line purchases. Buyer's premiums are determined by the auction and the rates can be found posted in several lots in the auction catalog. **ITEMS SOLD "AS IS, WHERE IS" All items are sold "AS IS, WHERE IS" with no warranty or guarantees, expressed or implied, by the seller or Koons Auctions. Bidders accept all auction items/property "WITH ALL FAULTS", whether immediately apparent. It is strongly recommended that bidders thoroughly inspect items before placing a bid. Items are described as accurately as possible, but do not represent any guarantee by the seller or Koons Auctions. By placing a bid, bidder signifies that they have inspected the item to their satisfaction. **PICTURES & ITEM DESCRIPTIONS: Multiple photos will be included in item descriptions whenever possible; however, photos may or may not fully represent the item. Lighting, surroundings and other factors can affect the perception of an item in a photo; therefore, all bidders are responsible for their own personal inspection of the item(s) before placing a bid. Payment must be received at time of checkout and pickup following the conclusion of the auction. If payment is not received or payment arrangements made within 7 days after the conclusion of the auction, the buyer will lose all right, title and interest to the item(s), including any and all moneys. Auction items will not be released for pickup until payment is made in full. SOMETIMES INVOICE EMAILS WILL BE DELIVERED TO YOUR SPAM/JUNK MAIL FOLDER. **PLEASE CHECK these folders before contacting us! **SHIPPING CUSTOMERS PAYMENTS: You will receive your regular invoice after the auction ends. Within a few days after that invoice, we will follow up with a SQUARE invoice that includes the 4% credit card convenience fee added. ****THAT INVOICE WILL HAVE A LINK FOR YOU TO PAY YOUR INVOICE ONLINE. Once your items are paid for. We will move your items to the shipper's area. He will pack your items and the INVOICE YOU SEPARATELY with a square invoice with a link for you to pay for your shipping. We experience high volumes of shipping. Customers can expect their packages to arrive at there destination 14-30 days after the auction. FAILURE to comply with these terms will prohibit bidder from participating in future live or on-line auctions conducted by Koons Auctions. SOMETIMES INVOICE EMAILS WILL BE DELIVERED TO YOUR SPAM/JUNK MAIL FOLDER. **PLEASE CHECK these folders before contacting us! **ITEM PICKUP: Removal and/or transportation of item(s) won on auction shall be at the expense, liability and risk of the buyer. Any Items not removed at the allotted checkout time, unless arrangements have been made and agreed upon by seller, will be considered abandoned and the purchaser will lose all right, title and interest to the property, including any and all moneys from the buyer. FAILURE to pickup/pay for items WILL result in buyer being PERMANENTLY BANNED from future auctions. BRING WITH YOU: Loading HELP, Tools, Carts, Packing materials, Load straps, Chains, Binders and any other items you may need to load, pack and haul your purchases. Some Items may need to be move up or down stairs. Bring Adequate Help With You. **SHIPPING: Koons Auctions does not ship items. However, SHIPPING IS AVAILABLE on most items through the independent outside shipper we work with. If you have questions if an item can be shipped. The packing of items takes time, materials, and staff. In the current times, both staff and materials are hard to come by for not only for our shipper, but also for USPS, UPS, SPEEDY and FedEx. These staffing issues are causing delays in shipping. These companies also know how to and are not afraid to charge for their services. ***While FOUR DIAMONDS (Shipper) will try to get items out as fast and as reasonable as possible. Customers should realize that not every customer's package can be the first one shipped. Due to the high volume of shipping required for our toy auctions, and the delays from shipping companies. For this reason, NO items will be packed for shipping until after payment in full has cleared! Most customers can expect to receive their package(s) from 14-30 DAYS AFTER auction invoice is paid in full. **HANDLING FEES: Minimum Handling fee on standard sized lots, will be $8.00 for the first lot. Handling on each additional standard sized toy lot will be $2.00 per lot. Large group(ed) lots may vary from this schedule! SHIPPING & INSURANCE FEES: Shipping will be calculated, and each package will be insured for the invoice amount at buyer's expense. If you have shipping questions. If a customer mistreats John, Koons Auction will ban that buyer from future auctions. **RETURNED CHECK FEES: A fee of $40.00 + ALL costs to recover will be assessed on returned checks and may result in the bidder being denied access to future auctions.
