By participating in this fundraiser auction, all bidders and participants agree to the following terms and conditions. 1. GENERAL AUCTION TERMS ---This is a charitable fundraiser auction benefiting Apogee Gulf Coast. ---Participation is open to the public unless otherwise noted for the Raffle Preview Items ---All items are sold as-is, where-is, with no warranties or guarantees unless explicitly stated by the donor. ---All sales are final. No refunds, exchanges, chargebacks, or cancellations. ---Descriptions and photos are provided to the best of our ability. Bidders are responsible for reviewing all information prior to bidding. ---Items, images, and descriptions may be updated prior to auction close. 2. ONLINE AUCTION BIDDING ---Online bidding is available through this auction platform for all items except the raffle preview items and place holder lots ---Bidding is open to anyone, including non-gala attendees (except on Raffle Preview Items) ---Online auction items will begin closing at the stated time following the gala. ---All bids are binding once placed and cannot be removed ---A maximum bid may be entered; the system will automatically bid on your behalf up to that amount, only if you are outbid ---All bids start at $2 and increase only if another bidder places a competing bid. 3. BUYER�S PREMIUM ---A 2% buyer�s premium applies to all online auction purchases. ---This premium exists to offset auction platform processing costs and ensure Apogee Gulf Coast receives the full intended donation. ---LL Auctions does not retain any portion of this premium for this fundraiser. 4. PAYMENT TERMS ---Payment instructions will be provided on the invoice sent after auction close. ---Preferred payment methods may include cash, Zelle, Venmo, or PayPal to help minimize processing fees. ---If alternative payment is not received by the stated deadline, the credit card on file may be automatically processed. ---Credit card payments will incur a 5% processing fee. ---Invoices must be paid in full prior to item pickup or shipping. ---Shipping will be charged separately 5. PICKUP & SHIPPING ---Buyers are responsible for arranging pickup or shipping. ---Pickup location (our warehouse located at 4311 Hwy 146 Bacliff, TX 77518) ---Pick Up Days: the Friday and Saturday following the close of the auction. ---Pick Up Times: Friday 10-5pm and Saturday 9-1pm ---Shipping is available for select items; buyers are responsible for shipping costs. ---Items not picked up or shipping arranged by the stated deadline will be considered abandoned ---Apogee families may have school pickup options available when noted. 6. RAFFLE ITEMS (IN-PERSON ONLY) ---Raffle items are preview-only online and not available for bidding. ---Raffle tickets are sold at the gala only (or via approved pre-sale links provided to ticket holders). ---Must be present at the gala to participate and win. ---Raffle tickets are entered toward specific prizes of the participant�s choosing. ---Winners will be announced live during the gala program. ---No substitutions or cash value. 7. TAX DEDUCTIBILITY ---Purchases and donations made through this fundraiser may be tax deductible to the extent allowed by law. ---Any amount paid above the fair market value of an item may qualify as a charitable contribution. ---Apogee Gulf Coast does not provide tax advice; consult a tax professional if needed. 8. DONOR TERMS & RESTRICTIONS ---Donated items may be subject to donor-specific restrictions, expiration dates, blackout dates, or scheduling requirements. ---All experiences must be redeemed directly with the donor. ---LL Auctions and Apogee Gulf Coast are not responsible for donor availability or fulfillment beyond the stated terms. 9. PLATFORM & TECHNICAL ISSUES ---LL Auctions is not responsible for technical issues, internet outages, or platform interruptions beyond its control. ---In the event of a system error, LL Auctions reserves the right to void or correct bids as necessary. 10. FINAL NOTES ---LL Auctions is generously donating its time, platform management, and administrative support for this fundraiser. ---All proceeds from this auction directly benefit Apogee Gulf Coast. ---By bidding, purchasing, or participating, you acknowledge and agree to these terms. |
