BECKER AUCTION LLC - ONLINE AUCTION TERMS & CONDITIONS

PLEASE READ THESE TERMS & CONDITIONS CAREFULLY. BY PARTICIPATING IN THIS AUCTION, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE, DO NOT BID.

1. AS-IS, WHERE-IS: All items are sold "AS IS, WHERE IS" with all faults. No warranties or guarantees are expressed or implied.

2. ACCURACY OF DESCRIPTIONS: While descriptions are believed to be accurate, they are not warranted. The Buyer is responsible for verifying condition, completeness, authenticity, and working condition before bidding.
Please Note: Becker Auction LLC assumes no liability for the accuracy of the description of the items being offered. If you, the Buyer, are relying solely on the description of the item, it is your responsibility to conduct your due diligence prior to bidding and determine what you believe is the asset being offered. If you have any questions, it is your responsibility to seek answers prior to bidding by any means necessary. If Becker Auction LLC cannot find a make or model number on an item, it will not be shown or assumed. No refunds will be issued for Buyer's Remorse if the item is not what they assumed it to be. Additionally, the presence of a serial number, model number, or other identifying information on an item or its packaging does not guarantee that the item inside is the same as what is listed. It is the Buyer's responsibility to verify all details before bidding.

3. BIDDER INSPECTION: Bidders are encouraged to inspect items in person. By placing a bid, the Bidder signifies that they have examined the item(s) to their satisfaction or have voluntarily chosen not to inspect them.

4. ALL SALES FINAL: No returns or refunds. The Buyer assumes full responsibility for item(s) upon the conclusion of the auction.

5. AUCTIONEER'S DISCRETION: Becker Auction LLC reserves the right to reject any bid at its sole discretion.

6. PAYMENT TERMS:
o A valid credit card is required to bid.
o Payment accepted in Cash, Credit/Debit Card, or Good Check (with a positive ID) payable to Becker Auction LLC.
o A 15% Buyer's Premium applies unless otherwise stated. A 5% discount will be applied for cash or check purchases on the Buyer Premium (resulting in a 10% Buyer Premium).
o Sales tax of 7.375% will be added unless a valid tax-exempt form is provided.

7. ITEM PICKUP & STORAGE FEES:
o Items must be picked up within the designated pickup days. Failure to do so will result in a 20% Buyer's Premium penalty and a $5 per day storage fee.
o Items left for more than seven (7) days will be resold for storage fees.
o If items remain unclaimed for 30 days, Becker Auction LLC reserves the right to resell them without further notice.
o If a Buyer's credit card is denied for outstanding payments, the Buyer will be permanently blocked from future auctions.

8. SHIPPING TERMS:
o Shipping is available but is done at the Buyer's risk.
o All shipping costs, including handling fees, are the responsibility of the Buyer.
o Becker Auction LLC is not liable for any damages, losses, or delays during shipping.

9. BUYER RESPONSIBILITY & LIABILITY:
o Buyers must bring sufficient manpower and tools for item removal.
o Becker Auction LLC and the Seller assume no responsibility for injuries or damages incurred during pickup or removal.
o Buyers assume all risks when accessing the auction premises and using tools or equipment.
o Any damage caused by a Buyer during removal must be fully compensated to the Seller.

10. DISPUTES & CHARGEBACKS:
o Buyers must contact Becker Auction LLC before initiating a chargeback. Any unauthorized chargebacks will be pursued aggressively to the fullest extent of the law.

11. AUCTION SITE HAZARDS:
o The auction site may present risks such as uneven terrain, heavy equipment, and dangerous tools.
o Buyers agree to hold harmless the Seller and/or Becker Auction LLC for any injuries or damages that occur while on-site.

12. GOVERNING VENUE & LEGAL FEES:
o Any legal disputes shall be handled exclusively in the courts of Fillmore County, Minnesota.
o If Becker Auction LLC prevails in any legal dispute, the Buyer shall be responsible for all attorney fees, court costs, and related legal expenses.

13. LIMITATION OF LIABILITY:
o Becker Auction LLC, its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the auction process, including but not limited to lost profits, business interruption, or loss of data, even if advised of the possibility of such damages. The total liability of Becker Auction LLC, regardless of the cause of action, shall not exceed the amount paid by the Buyer in the auction.

14. SEVERABILITY CLAUSE:
o If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

15. AMENDMENTS TO TERMS:
o Any changes or amendments to these terms must be made in writing and signed by both parties to be valid.

16. EXTENDED BIDDING & CLOSING TIMES:
o Online bidding only.
o Items close at a rate of 6 items per minute (one every 10 seconds).
o "Extended bidding" applies: if a bid is placed within the final 2 minutes, bidding extends for an additional 2 minutes until there is a full 2-minute period without a new bid.

17. PRECEDENCE OF TERMS:
o By participating in this auction, the bidder acknowledges and agrees that the Terms & Conditions set forth by Becker Auction LLC supersede and take precedence over any conflicting terms or policies set forth by the Auction Flex/HiBid Platform or any third-party bidding platform. In the event of any discrepancy, the terms stated by Becker Auction LLC shall govern.

18. CONSIGNMENT & ESTATE SALES:
o Becker Auction LLC operates as an auctioneer on a consignment basis and estate basis. We do not own the items being sold.
o Items are sold on behalf of consignors or estates, and all representations of items are based on the information provided by the seller.
o It is the Buyer's responsibility to conduct due diligence on items before placing a bid.

ITEM PICKUP & STORAGE FEES: o Items must be picked up within the designated pickup days. Failure to do so will result in a 20% Buyer's Premium penalty and a $5 per day storage fee. o Items left for more than seven (7) days will be resold for storage fees. o If items remain unclaimed for 30 days, Becker Auction LLC reserves the right to resell them without further notice. o If a Buyer's credit card is denied for outstanding payments, the Buyer will be permanently blocked from future auctions. 8. AUCTION SITE HAZARDS: o The auction site may present risks such as uneven terrain, heavy equipment, and dangerous tools. o Buyers agree to hold harmless the Seller and/or Becker Auction LLC for any injuries or damages that occur while on-site. 12. GOVERNING VENUE & LEGAL FEES: o Any legal disputes shall be handled exclusively in the courts of Fillmore County, Minnesota. o If Becker Auction LLC prevails in any legal dispute, the Buyer shall be responsible for all attorney fees, court costs, and related legal expenses. 13. LIMITATION OF LIABILITY: o Becker Auction LLC, its affiliates, officers, employees, and agents shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from or related to the auction process, including but not limited to lost profits, business interruption, or loss of data, even if advised of the possibility of such damages. The total liability of Becker Auction LLC, regardless of the cause of action, shall not exceed the amount paid by the Buyer in the auction. 14. SEVERABILITY CLAUSE: o If any provision of these Terms & Conditions is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. 15. AMENDMENTS TO TERMS: o Any changes or amendments to these terms must be made in writing and signed by both parties to be valid. 16. EXTENDED BIDDING & CLOSING TIMES: o Online bidding only. o Items close at a rate of 6 items per minute (one every 10 seconds). o "Extended bidding" applies: if a bid is placed within the final 2 minutes, bidding extends for an additional 2 minutes until there is a full 2-minute period without a new bid. 17. PRECEDENCE OF TERMS: o By participating in this auction, the bidder acknowledges and agrees that the Terms & Conditions set forth by Becker Auction LLC supersede and take precedence over any conflicting terms or policies set forth by the Auction Flex/HiBid Platform or any third-party bidding platform.
