ONLINE AUCTION TERMS AND CONDITIONS
VERY IMPORTANT! READ CAREFULLY BEFORE YOU ATTEMPT TO BID. ONCE YOU BID, YOU WILL BE BOUND LEGALLY BY THE FOLLOWING TERMS AND RULES THAT ARE STATED HERE. BY REGISTERING FOR OUR AUCTIONS, IT'S CONSIDERED AS A CONTRACT AND THE FOLLOWING TERMS APPLY. TERMS AND CONDITIONS CAN CHANGE DEPENDING ON THE CIRCUMSTANCES OF EACH SALE. IT IS VERY IMPORTANT TO REVIEW THE TERMS BEFORE PARTICIPATING IN ANY AUCTION!

PURCHASE PICKUPS AT MARQUEE LIQUIDATION SERVICES FACILITY
All bidders will be required to pickup their items the Tuesday & Wednesday after the auction closes between 10am and 4pm. Any leftover items will be subject to a $10 per lot per day charge. Any items left for more than 7-business days past the pickup time will be forfeited and you will not receive a refund. We are not responsible for damage to any items, or lost items left past the scheduled pickup time.

PICKUP ITEM REMOVAL
Winning bidders are fully responsible for removal of all their purchased items during pickups. Any items not removed during scheduled pickups will incur $50 abandonment clean-up and deposal fee. Any property damages caused during pickup is 100% the winning bidder's responsibility.

SPECIAL CASE PICKUPS
We can SOMETIMES make special arrangements for pickups outside our normal pickup date/time for minimum fee of $25.

AUCTION PICKUP AND REMOVAL NOT LOCATED AT MARQUEE LIQUIDATION SERVICES
Many of our On-Site Auction Locations are transferring to new owners the next day so pickup times are STRONGLY ENFORCED! Any items not removed in the time frame listed, or load-out times will be subject to a minimum charge of $25 per lot fee for moving cost. Large items and furniture will be subject to a minimum $50 per lot fee. Any items leftover from any of these auctions that have not been picked within 24-hours will be considered abandoned and you will forfeit said items and you will not receive a refund. Any items not paid for or picked up during the scheduled pickup times will result in your bidding privileges being revoked.
Our staff will not assist in the load-out process. Make sure to bring help to load your items. You are responsible for loading items into your vehicle. Marquee Liquidation Services LLC is not responsible for loading items for safe travel. We are not responsible for damages to any items, or lost items left past the scheduled pickup time.
The following fees WILL be charged to the credit card on file when necessary:
* A $10 Credit Card Reprocessing Fee For Any Denied Credit Cards.
*The purchaser will be charged a $25 non-removal fee for any lot or partial lot left behind, as well as all disposal costs.
*The buyer will be charged $50/hour if you require our staff to stay past the designated ending time.
*Repeated tardiness and or failure to remove items will result in revocation of bidding privileges on ALL of our bidding platforms.

AUCTION CLOSING TIMES AND TECHNICAL DIFFICULTIES
Our Online Auction closings are set with a delay between lot closings. This is to help you with bidding on multiple items in the same auction. Our auctions are NOT set to close all lots at one time. In the event of any website malfunctions, or technical difficulties, the bidding for the entire auction will be reopened, and set to a later closing time. This does not include difficulties with you as the buyer's internet or bidding equipment. In the event of any technical difficulties, you as the buyer hold Marquee Liquidation Services LLC harmless for any damages, or cost incurred.

BUYER'S PREMIUM
A Buyer's premium will be charged on each purchase. A buyer's premium is an advertised percentage of the high bid or flat fee added to the high bid and becomes part of the purchase amount at settlement. Buyer agrees to these provisions and will pay the applicable buyer's premium.

SHIPPING & HANDLING
All orders needing shipping will be handled by our third party shipper Pack, Ship & Copy. In the event you would like your small items shipped please know we are a small family business therefore we do NOT provide FREE shipping. Shipping and handling charges will be a separate charge to the card on file with HiBid at the time of shipping.

If you do require shipping, the following fees will apply $10.00 packaging fee for materials and processing per box. With the exception of small items such as single trading cards, postcards, stamps and coins that fit in an envelope. Such items will incur a $1 handling fee per envelope. We WILL combine lots for shipping to minimize costs unless advised otherwise.

Note: Oversize or extremely delicate items will be marked with Lot Notice: If shipping is required, winning bidder is fully responsible for making arrangements as well as coordinating with preferred shipper of choice and the Auction House. All actual shipping costs and insurance will be charged to the card on file with HiBid. Unless specified by you, items will be insured for invoiced amount.

Shipping invoice not paid in full within 48-hours of invoice emailed will therefore be forfeiture of all items in said lots / orders. The Auction House reserves the right to dispose of any and all forfeited items as seen fits best for Marquee Auctions and/or clients. No refunds for forfeited orders due to non-paid shipping invoices.

ADDITIONAL SHIPPING
Marquee Auctions uses pickup scheduler software services provided by Shipping Saint. Bidders can expect Text / Email from Shipping Saint with order updates. All orders required shipping will be handled and shipped by our third party shipper Pack, Ship & Copy. PSC will communicate via phone or email with winning bidders order shipping information. Shipping invoices will be insured for the full purchase price and include packing and handling fees and are a separate charge from the goods being sold at auction. At times particular lots (e.g., large items such as furniture, appliances, framed artwork, etc.) will be noted within such lot pages In-house shipping not available. Buyer is responsible for making arrangements and coordinating shipping for any and all such lots. Failure to do so will result in absolute lot forfeit.

**NOTE: All shippable orders will be handled and shipped via our third party shipper All-In Mailing and Business Services - (682) 248-3101.

**The Auction House and All-In will not provide pre-shipping quotes. Quotes will be determined post auction close date when orders are pulled and processed for shipping.

Items that are forfeit because of shipping costs will be subject to a $25.00 restocking fee and future bidding will be at the discretion of the Auction House. NO REFUNDS WILL BE GIVEN FOR ANY CUSTOMERS REFUSING TO PAY SHIPPING & INSURANCE. We will NOT accept pre-paid shipping labels from outside sources but buyers may arrange their own packing and shipping with an outside source but the Auction House must be notified immediately following the auction close date. Buyer will be held full responsibility for making such arrangements, paying such invoices, and coordinating such arrangements with their preferred shipper and the Auction House. The Auction House will not pack buyer's items with arrangements for buyer's preferred shipper. Buyer must coordinate a pick-up or drop-off schedule with shipper and the Auction House. The Auction House will provide a 15-mile radius for order delivery to buyer's preferred drop-off location. A $50 drop-off fee will apply per order needing delivered by the Auction House to buyer's preferred shipper location within the 15-mile radius. For Example, bidder wins a large furniture set, which qualifies as a non-in-house shippable order. Said order will then be transferred over to the buyer's preferred shipper for processing.

ALL OF OUR ONLINE AUCTION'S FEATURE BOTH A MAX BID OPTION AS WELL AS A SOFT CLOSE.

SALES TAX
Sales tax will be charged and collected on all purchases, as required by appropriate state / local laws. If you are sales tax exempt, you will need to provide to Marquee Liquidation Services LLC a copy of your Sales and Used Tax Certificate. Provide copy to admin@marqueeliquidationservices.com.

THIS INCLUDES COINS. In the event that you enter a tax number and we do not have the form on file you will be required to pay the sales tax before you pick up your purchases.

PAYMENT
We will automatically charge the card on file with HiBid at the close of the auction unless other payment arrangements have been made with the Auction Company. The credit card on file with HiBid will be charged for your total purchases including any buyer's premium or stated additional fees after the auction closes. All denied transactions due to expiration date, non-sufficient funds, and or other reasons shall be subject to a $10 reprocessing fee. You can update your credit card under "PROFILE" on the website dashboard. You as the buyer are responsible for keeping your credit card on file and up-to-date. A paid invoice will be sent to your registered email address within 12-hours following the conclusion of the auction. If you do not receive an invoice, please check the dashboard under "PROFILE"-"INVOICES"
If the total amount in purchases is over $2500.00 the Auctioneer may require a $500 deposit ran on the credit card on file with HiBid and the balance MUST be settled for with CASH, wire transfer or previous arrangements made with the Auction Company. No item will be released or transferred until payment has posted to our account.

ALL COINS, PAPER MONEY & JEWELRY over $1,000 MUST be delivered with signature required. ABSOLUTELY NO DELIVERIES TO PO BOXES WITHOUT VERBAL CONFIRMATION & PIC OF PHOTO ID. We will no longer offer the option to waive insurance on any packages. In order to ship firearms that require a background check, valid photo ID, and valid FFL. USE OF MARQUEE LIQUIDATION SERVICES LLC PHOTOS AND DESCRIPTIONS
All photos, and descriptions are property of Marquee Liquidation Services LLC. Any use of the photos, and / or description listed on Marquee Liquidation Services LLC website and / or marqueeliquidationservices.hibid.com are prohibited. Marquee Liquidation Services LLC does not give any permission to use any of their photos, and / or description on any other site.

BID RETRACTIONS
Marquee Liquidation Services LLC does not allow any bid retractions of any kind. In the event you as a bidder enter the wrong max bid amount, we will be able to adjust your max bid to the current high bid online. You as the buyer will remain the current high bidder. This is at the discretion of Marquee Liquidation Services LLC ONLY and will only be considered if the actual bid placed was determined (by Marquee Liquidation Services LLC) to be in error.

BASIC AUCTION TERMS & CONDITIONS
Marquee Liquidation Services LLC retains the right to govern goods and services sold to clients and to maintain the level and integrity of our business. Marquee Liquidation Services LLC has the right to terminate the auction at any time; withdrawal from sale of any item; to sell at this auction items not listed; to group one of more lots into one or more selling lots or to subdivide into two lots or more selling lots. The auction company also reserves the right to sell all of the items listed in bulk. **All metal / plastic shelving racks, jewelry trays, displays of any sort Not For Sale (NFS).

NO LIABILITY
a) Marquee Liquidation Services LLC assumes no liability for your purchases. The buyer assumes and does agree to indemnify and hold the auction company and seller harmless from any future claim that shall pertain to fitness or use of the asset being purchased. b) Persons attending during exhibition, sale or removal of goods assume all risks of damage or loss to person and property and specifically release and indemnify the Auction Company from liability, therefore. Neither the Auction Company nor his principal or seller shall be liable by reason of any defect in or condition of the premises in which the sale is held. Any debt collection or dispute proceedings will be required to be litigated, arbitrated, or mediated in Liberty County, Texas.

CONSIGNORS & BIDDERS
a) All consignors must fill out a contract with Marquee Liquidation Services LLC, sign forms and abide by our terms listed. b) All bidders must register for bidder's numbers using proper ID or proper information. c) No consignor, seller, or agent for seller has the right to bid on their
consigned goods. d) All items become the sole responsibility of the purchaser when the auctioneer confirms your bid as the successful winner. We are not responsible for lost or stolen items. e) The Auction House acknowledges no restrictions on who bids. Family, friends, employees and the general public are permitted to participate in online bidding. f) Bidder's with a negative score will be declined registration and participation in online bidding.

LOSS OF BIDDING PRIVILEGES
a) If you have failed to pay for an item, or failed to timely pickup items, your bidding privileges will be revoked. Your privileges may be restored by paying for the item or repaying for the loss of the revenue due to the items not having been sold and by placing a credit card on permanent file whereby future purchases will automatically be charged. You will only be given this chance one time. Repeated tardiness, or nonpayment will result in permanent denied bidding privileges.

DELINQUENT ACCOUNTS
a) The bidder that has not paid for or has not removed their items from the auction site, will be subject to the cost of storage, trucking, re-sale, deficiency balances, collection fees, and any legal fees for recouping a loss due to the bidder's negligence. Any unpaid invoices must be paid within 24-hours of the auction closing. After the 24-hour period your bidding privileges will be revoked permanently.

RESERVES
a) Any and all items that Marquee Liquidation Services LLC agrees to sell are subject to a reserve as per Texas State Auction Law.

DOCUMENTS
a) All documents must be completed in full by buyers and sellers. For Example: Death Certificates, Letters of Authority, Creditor Liens, and UCC's when purchasing vehicles, FFL for firearms, etc. b) All gun buyers will be required to fill out a 4473 form and pass a background check. Out of state buyers will be required to have any and all guns shipped to an FFL (Federal Firearms License) Dealer.

COMPLIANCE WITH THE TERMS OF SALE
a) In default of payment of bills in full within the time announced for this auction the Auction Company in addition to all other remedies allowed by law, may retain all monies received as deposit or otherwise, as liquidated damages. b) Marquee Liquidation Services LLC is in complete accordance with Texas statutes and Texas Administrative codes. Warranties: a) Everything is sold "AS IS / WHERE IS" with no warranties, representation or guarantees expressed, implied or otherwise given. All sales are final.

CONDITIONS OF ITEMS SOLD
a) All information is believed to be accurate, but the auction company shall not be responsible for the correct description, authenticity, genuineness of or defect in any lot, and makes no warranty in connection there with. No allowance will be made, or sale set aside on account of any incorrectness, error in cataloging or any imperfection not noted. No deduction will be allowed on damaged articles as all goods being exposed for public exhibition are sold "as is" and without recourse. Please do your own due diligence on the authenticity of items. We sell all items "as-is" "where-is" and we do not represent any item as authentic and ask that you come in person to inspect these items. All sales are final and non-refundable.

Marquee Liquidation Services LLC requires any and all buyers to preview and make your own assessment of conditions.

BIDDER REGISTRATION
Bidders must be 18 years of age or older and are required to register for the auction. In registration, Bidder must submit information found to be current, complete, and accurate for proper identification. Auctioneer does not sell or rent this information. Auctioneer uses email mailing lists to notify customers about online and live auctions. Customers who do not wish to be notified should contact the office of the Auctioneer and request removal from the email mailing list. Bidder is responsible for security of his/her bidding number / username and password, and any and all bids placed under the assigned number- ID. Auctioneer should be notified immediately if Bidder believes number and/or password have been compromised. Auctioneer reserves the right to terminate registration, deny any person for any reason permission or access to bid, to reject any and all bids, and to suspend or ban Bidder from bidding, at Auctioneers sole discretion. Bidder registration is not transferable or assignable.

ONLINE BIDDING INFORMATION
Bidder acknowledges that hardware malfunctions, software malfunctions, viruses, and similar issues do occur and are beyond the knowledge, scope, and control of Auctioneer. We are NOT responsible for your system malfunctions, connection to the internet or your email client stopping any of our emails to you regarding bid confirmations and or outbid notifications.

EMERGENCY CASES
In the event the HiBid platform encounters an emergency situation, all active auctions will pause and resume for a future date.
