Auction Terms & Conditions
Payment may be made by cash, check, or credit card. All items are sold AS-IS, WHERE-IS with no warranties expressed or implied. A 15% buyer�s premium will be added to all purchases. Indiana sales tax of 7% will be charged where applicable. If you are tax exempt, please email the auction company prior to the end of the auction and provide proper documentation.
If you do not wish to bid online, please contact the office at 812-491-6247 to make alternate bidding arrangements.

ALL SALES ARE FINAL � NO RETURNS OR REFUNDS. All items must be sold through the auction process. No pre-sales will be permitted.

This auction features a 2 Minute soft Close with a 15 second stagger time for each lot.

Vehicle Purchases
Credit cards will NOT be accepted for vehicle purchases. Payment for vehicles must be made by cash or check only. Vehicle titles will be mailed within 14 business days after payment has cleared. Winning bidders are responsible for all pickup and transportation arrangements for vehicles.

Technical Issues
This is an online-only auction and relies on technology that may malfunction without warning. In the event of technical issues related to the server, software, internet connection, or auction platform, Baker Auction & Realty, LLC reserves the right to:Extend the bidding time, Continue bidding, or Close the bidding. Baker Auction & Realty, LLC and the software provider shall not be held liable for any malfunction, error, or inconvenience resulting from such issues.

Auctioneer Rights
Baker Auction & Realty, LLC reserves the right to: Cancel the auction at any time, Remove any lot prior to the close of bidding, Reject any bid for any reason. An accepted bid constitutes a legally binding contract. The bidder assumes all risk of loss or damage to the item at the conclusion of the auction. Baker Auction & Realty, LLC reserves the right to resell any item not paid for by the stated pickup deadline. The original bidder remains responsible for the purchase price and any collection costs or damages resulting from resale. Auction company employees and/or the auction company may bid in the auction.

Bidder Verification
The identity of all bidders will be verified. Baker Auction & Realty, LLC reserves the right to reject bidder registration if there are concerns regarding credentials. Bidders are responsible for maintaining the confidentiality of their username and password and are responsible for all activity conducted under their account. All users must comply with local, state, and federal laws while using the auction platform.

Payment Terms
All purchases will be automatically charged the morning after the auction closes to the credit card on file with HiBid. By registering to bid and providing a credit card for payment, the bidder authorizes Baker Auction & Realty, LLC to charge the credit card on file for all purchases, buyer�s premiums, sales tax, shipping, handling, and any other applicable fees associated with items won in the auction. By registering for the auction and placing a bid, the bidder expressly acknowledges that they are participating in a binding online auction and not a retail purchase, and therefore chargebacks or payment reversals are not an acceptable method of dispute resolution. The bidder further acknowledges that their act of placing a bid constitutes electronic acceptance of these Terms & Conditions, and this acceptance may be used as evidence in any chargeback dispute, arbitration, or court proceeding.Bidders expressly agree not to initiate a chargeback or payment dispute with their credit card provider or bank for any purchase made through the auction platform. All sales are final, and any disputes regarding purchases must be addressed directly with Baker Auction & Realty, LLC. Initiating a chargeback or payment dispute without first contacting Baker Auction & Realty, LLC to resolve the matter will be considered a breach of these Auction Terms & Conditions. In the event a chargeback is initiated, the bidder agrees that: The bidder remains legally responsible for the full purchase amount, including buyer�s premium, taxes, shipping, and any applicable fees. The bidder agrees to reimburse Baker Auction & Realty, LLC for all costs associated with the chargeback, including but not limited to: bank fees, credit card processor fees, administrative costs,collection costs & reasonable attorney�s fees. Baker Auction & Realty, LLC reserves the right to pursue all legal remedies available, including collections and legal action, to recover unpaid balances resulting from a chargeback. Any bidder who initiates a chargeback may be permanently banned from participating in future auctions conducted by Baker Auction & Realty, LLC and may be reported to the auction platform and other auction companies. By placing a bid, the bidder acknowledges and agrees that a chargeback does not cancel or invalidate the bidder�s obligation to pay for items won.

If you do not wish your card to be charged, you must contact the auction company within 24 hours prior to the close of the auction to make alternate payment arrangements. Payment must be completed before items are removed. If payment has not been received by the final scheduled pickup day, the purchase will be considered in default. The bidder may be blocked from participating in future Baker Auction & Realty auctions, and the item may be offered to the next highest qualified bidder.The bidder agrees to pay all reasonable attorney fees and collection costs incurred by Baker Auction & Realty, LLC in collecting unpaid balances. A late fee of 2% per month will be applied to all outstanding balances.

Pickup Policy
Items must be picked up on the scheduled pickup date unless prior arrangements are made. Items left after the scheduled pickup time will be forfeited to Baker Auction & Realty, LLC with no refund issued. Bidders are responsible for packing, loading, and transporting their purchases. The auction company will not provide labor, tools, boxes, or packing materials. Buyers of large items must bring adequate help and equipment for removal.

Shipping
Shipping is available at the buyer�s expense for items small enough to ship via USPS Priority Mail, USPS Flat Rate, UPS, or FedEx Ground. Furniture and vehicles must be picked up in person or shipped using a professional shipper arranged by the buyer. If a professional shipper is used, the buyer must notify the auction company and coordinate shipping directly with the shipper. Oversized, delicate, or specialty items may be delivered to a third-party shipper. A $25 delivery fee will apply. Baker Auction & Realty does not palletize or ship furniture. All shipping charges will be invoiced through Shipping Saint. Packages shipped by the auction company will include insurance equal to the hammer price. There is a minimum shipping and handling charge of $10.00. Please allow 7 business days after the final pickup date for items to be shipped.
Once a package has been delivered to the shipping carrier (USPS, UPS, FedEx, or other carrier), all risk of loss or damage transfers to the buyer. Baker Auction & Realty, LLC is not responsible for damages, delays, or loss caused by the shipping carrier. If a package arrives damaged, the buyer must: Retain all packaging materials, boxes, and contents & Notify Baker Auction & Realty, LLC within 3 business days of delivery. Once notified of damage, Baker Auction & Realty, LLC will forward Buyer a Shipping Saint Claim Form. The buyer is responsible for coordinating with Shipping Saint and the shipping carrier regarding the claim. Baker Auction & Realty, LLC will provide reasonable documentation related to the shipment if requested but is not responsible for filing or managing shipping insurance claims.

Liability
Buyer and/or bidder agrees to hold harmless and indemnify Baker Auction & Realty, LLC, including its agents, owners, employees, and representatives, from any claims, damages, judgments, costs, or fees. If Baker Auction & Realty, LLC is unable to deliver any purchased item, the sole liability of the auction company shall be the return of the purchase funds upon return of the item.

Personal Guarantee
If a bid is submitted in the name of a business or corporate entity, the individual placing the bid personally guarantees payment of the bid amount if the entity fails to pay, including all collection costs and reasonable attorney fees.

Jury Trial Waiver
Each party knowingly, voluntarily, and intentionally waives the right to a trial by jury in any dispute arising from this agreement. All disputes shall be heard by a judge sitting without a jury in a court of competent jurisdiction located in Vanderburgh County, Indiana.

Agreement to Terms
By placing a bid, the bidder acknowledges that they have read, understood, and agree to all terms and conditions outlined above.

Auction Terms & Conditions Payment may be made by cash, check, or credit card. All items are sold AS-IS, WHERE-IS with no warranties expressed or implied. A 15% buyer�s premium will be added to all purchases. Indiana sales tax of 7% will be charged where applicable. If you are tax exempt, please email the auction company prior to the end of the auction and provide proper documentation. If you do not wish to bid online, please contact the office at 812-491-6247 to make alternate bidding arrangements. ALL SALES ARE FINAL � NO RETURNS OR REFUNDS. All items must be sold through the auction process. No pre-sales will be permitted. This auction features a 2 Minute soft Close with a 15 second stagger time for each lot. Vehicle Purchases Credit cards will NOT be accepted for vehicle purchases. Payment for vehicles must be made by cash or check only. Vehicle titles will be mailed within 14 business days after payment has cleared. Winning bidders are responsible for all pickup and transportation arrangements for vehicles. Item Condition & Listing Information Baker Auction & Realty, LLC assumes no responsibility for missing or incorrect listing information. All information is gathered from sources believed to be reliable but is not guaranteed. Descriptions and listings may be updated, corrected, or removed at any time without notice.By bidding, all bidders acknowledge that their decision to bid and the amount bid are based solely upon their own inspection and evaluation of the item(s). Technical Issues This is an online-only auction and relies on technology that may malfunction without warning. In the event of technical issues related to the server, software, internet connection, or auction platform, Baker Auction & Realty, LLC reserves the right to:Extend the bidding time, Continue bidding, or Close the bidding. Baker Auction & Realty, LLC and the software provider shall not be held liable for any malfunction, error, or inconvenience resulting from such issues. Auctioneer Rights Baker Auction & Realty, LLC reserves the right to: Cancel the auction at any time, Remove any lot prior to the close of bidding, Reject any bid for any reason. An accepted bid constitutes a legally binding contract. The bidder assumes all risk of loss or damage to the item at the conclusion of the auction. Baker Auction & Realty, LLC reserves the right to resell any item not paid for by the stated pickup deadline. The original bidder remains responsible for the purchase price and any collection costs or damages resulting from resale. Auction company employees and/or the auction company may bid in the auction. Bidder Verification The identity of all bidders will be verified. Baker Auction & Realty, LLC reserves the right to reject bidder registration if there are concerns regarding credentials. Bidders are responsible for maintaining the confidentiality of their username and password and are responsible for all activity conducted under their account. All users must comply with local, state, and federal laws while using the auction platform. Payment Terms All purchases will be automatically charged the morning after the auction closes to the credit card on file with HiBid. By registering to bid and providing a credit card for payment, the bidder authorizes Baker Auction & Realty, LLC to charge the credit card on file for all purchases, buyer�s premiums, sales tax, shipping, handling, and any other applicable fees associated with items won in the auction. By registering for the auction and placing a bid, the bidder expressly acknowledges that they are participating in a binding online auction and not a retail purchase, and therefore chargebacks or payment reversals are not an acceptable method of dispute resolution. The bidder further acknowledges that their act of placing a bid constitutes electronic acceptance of these Terms & Conditions, and this acceptance may be used as evidence in any chargeback dispute, arbitration, or court proceeding.Bidders expressly agree not to initiate a chargeback or payment dispute with their credit card provider or bank for any purchase made through the auction platform. All sales are final, and any disputes regarding purchases must be addressed directly with Baker Auction & Realty, LLC. Initiating a chargeback or payment dispute without first contacting Baker Auction & Realty, LLC to resolve the matter will be considered a breach of these Auction Terms & Conditions. In the event a chargeback is initiated, the bidder agrees that: The bidder remains legally responsible for the full purchase amount, including buyer�s premium, taxes, shipping, and any applicable fees. The bidder agrees to reimburse Baker Auction & Realty, LLC for all costs associated with the chargeback, including but not limited to: bank fees, credit card processor fees, administrative costs,collection costs & reasonable attorney�s fees. Baker Auction & Realty, LLC reserves the right to pursue all legal remedies available, including collections and legal action, to recover unpaid balances resulting from a chargeback. Any bidder who initiates a chargeback may be permanently banned from participating in future auctions conducted by Baker Auction & Realty, LLC and may be reported to the auction platform and other auction companies. By placing a bid, the bidder acknowledges and agrees that a chargeback does not cancel or invalidate the bidder�s obligation to pay for items won. If you do not wish your card to be charged, you must contact the auction company within 24 hours prior to the close of the auction to make alternate payment arrangements. Payment must be completed before items are removed. If payment has not been received by the final scheduled pickup day, the purchase will be considered in default. The bidder may be blocked from participating in future Baker Auction & Realty auctions, and the item may be offered to the next highest qualified bidder.The bidder agrees to pay all reasonable attorney fees and collection costs incurred by Baker Auction & Realty, LLC in collecting unpaid balances. A late fee of 2% per month will be applied to all outstanding balances. Pickup Policy Items must be picked up on the scheduled pickup date unless prior arrangements are made. Items left after the scheduled pickup time will be forfeited to Baker Auction & Realty, LLC with no refund issued. Bidders are responsible for packing, loading, and transporting their purchases. The auction company will not provide labor, tools, boxes, or packing materials. Buyers of large items must bring adequate help and equipment for removal. Shipping Shipping is available at the buyer�s expense for items small enough to ship via USPS Priority Mail, USPS Flat Rate, UPS, or FedEx Ground. Furniture and vehicles must be picked up in person or shipped using a professional shipper arranged by the buyer. If a professional shipper is used, the buyer must notify the auction company and coordinate shipping directly with the shipper. Oversized, delicate, or specialty items may be delivered to a third-party shipper. A $25 delivery fee will apply. Baker Auction & Realty does not palletize or ship furniture. All shipping charges will be invoiced through Shipping Saint. Packages shipped by the auction company will include insurance equal to the hammer price. There is a minimum shipping and handling charge of $10.00. Please allow 7 business days after the final pickup date for items to be shipped. Once a package has been delivered to the shipping carrier (USPS, UPS, FedEx, or other carrier), all risk of loss or damage transfers to the buyer. Baker Auction & Realty, LLC is not responsible for damages, delays, or loss caused by the shipping carrier. If a package arrives damaged, the buyer must: Retain all packaging materials, boxes, and contents & Notify Baker Auction & Realty, LLC within 3 business days of delivery. Once notified of damage, Baker Auction & Realty, LLC will forward Buyer a Shipping Saint Claim Form. The buyer is responsible for coordinating with Shipping Saint and the shipping carrier regarding the claim. Baker Auction & Realty, LLC will provide reasonable documentation related to the shipment if requested but is not responsible for filing or managing shipping insurance claims. Liability Buyer and/or bidder agrees to hold harmless and indemnify Baker Auction & Realty, LLC, including its agents, owners, employees, and representatives, from any claims, damages, judgments, costs, or fees. If Baker Auction & Realty, LLC is unable to deliver any purchased item, the sole liability of the auction company shall be the return of the purchase funds upon return of the item. Personal Guarantee If a bid is submitted in the name of a business or corporate entity, the individual placing the bid personally guarantees payment of the bid amount if the entity fails to pay, including all collection costs and reasonable attorney fees. Jury Trial Waiver Each party knowingly, voluntarily, and intentionally waives the right to a trial by jury in any dispute arising from this agreement. All disputes shall be heard by a judge sitting without a jury in a court of competent jurisdiction located in Vanderburgh County, Indiana. Agreement to Terms By placing a bid, the bidder acknowledges that they have read, understood, and agree to all terms and conditions outlined above.
