LOCAL LINE AUCTIONS, LLC GENERAL TERMS AND CONDITIONS FOR BIDDING AND BUYING 1. REGISTRATION All bidders must be at least 18 years of age and provide valid government-issued identification. Auctioneer reserves the right to deny registration or bidding privileges to any individual at its sole discretion. 2. BIDDING PROCESS All bids are binding and final. The highest bid acknowledged by the Auctioneer will be the buyer. Auctioneer reserves the right to resolve any disputes, refuse any bid, and remove any item from sale at any time. 3. BUYER’S PREMIUM A 10% Cash Buyer’s Premium and additional 4% credit card fee will be added to the final bid price of all items. The Buyer’s Premium is taxable and subject to New York State sales tax. 4. SALES TAX New York State and local sales tax will be applied to all purchases unless a valid resale certificate or tax exemption form is5. PAYMENT TERMS Payment is due immediately upon conclusion of the auction. Accepted payment methods include cash, approved credit/debit cards, and wire transfers. A $35 fee applies to all returned checks. Chargebacks or non-payment will be prosecuted to the full extent of the law. 6. CONDITION OF ITEMS All items are sold 'AS IS, WHERE IS' with no warranties expressed or implied. No refunds, exchanges, or returns will be accepted. Bidders are responsible for inspecting items prior to bidding and should rely solely on their judgment. 7. TITLE AND RISK OF LOSS Title to items transfers to the buyer upon full payment and acceptance of the item. The buyer assumes all risk of loss or damage at that point. if items are not removed in 7 days the auctioneer in its sole discretion has the right to discard resell or donate abandoned items with no reimbursement or refund to buyer 8. DEFAULT AND REMEDIES In the event of default, Auctioneer may resell the item(s) and recover damages including lost commissions, storage fees, the Buyer agrees to indemnify and hold harmless Auctioneer from any claims arising from such default. 9. LIMITATION OF LIABILITY Auctioneer shall not be liable for any indirect, consequential, or punitive damages arising from the auction process. Liability, if any, shall be limited to the amount paid by the buyer for the disputed item(s). 10. GOVERNING LAW AND JURISDICTION These Terms and Conditions are governed by the laws of the State of New York. Any disputes shall be resolved exclusively in the courts of Chenango County, NY. 11. ENTIRE AGREEMENT These terms constitute the entire agreement between the parties and supersede all prior discussions or representations. No oral statements shall modify these terms. 12. SEVERABILITY If any provision of these terms is held invalid or unenforceable, the remaining provisions shall remain in full force and effect
